West Bengal Upper Primary Judgement by Calcutta High Court

On Wednesday, the division bench of Justices Tapabrata Chakraborty and Partha Sarathi Chatterjee in the Calcutta High Court has released an order to the Commission directing it for the same. The court has also set a time limit of 12 weeks to the Commission for completion of the recruitment procedure. According to the official data, the judgement was made following the hearing of 36 appeals related to the 2016 State Level Selection Test (SLST).

The court instructed the SSC to prepare and release the final merit list for these candidates within four weeks. Following the publication of the merit list, the SSC is required to conduct counseling sessions and make recommendations for the appointment of the candidates within the next four weeks. Once these recommendations are made, the relevant authorities are expected to issue appointment letters to the candidates within an additional four-week period.

The SLST 2016, conducted under the rules of the West Bengal School Service Commission, has faced multiple legal challenges. The initial merit list was released in October 2019, but the selection process was contested in several writ petitions, leading to a single bench of the High Court annulling the entire process and ordering a fresh selection procedure. The SSC was also directed to verify the credentials of the candidates, including their Teacher Eligibility Test (TET) certificates and other qualifications.

In response to the single bench’s order, the SSC issued a new interview list in June 2021, identifying 14,339 final vacancies, excluding a 10 percent reservation for para-teachers. Dissatisfaction with the single bench’s rulings led to the filing of multiple appeals, which culminated in the recent directive from the division bench.
